Trump Administration to Resrict Migration of International Students for Online-Only Classes

The Trump administration has announced new guidelines that will block any new student planning to enroll in the online-only study from entering the United States.


The United States has the highest number of foreign immigrants. As the country went into lockdown beginning in March 2020 to control the spread of the coronavirus, tens of millions of workers lost their jobs within weeks, particularly in sectors that require face-to-face interaction, such as restaurants, hotels, shops, and even health clinics.

President Trump also extended a near total ban that he had first announced  in April, on entry into the United States by immigrants seeking “green cards” for permanent residency.

In addition – by this new policy – US will not allow the entry of new international students for the upcoming fall semester if their courses are entirely online, the Immigration and Customs Enforcement (ICE) said.

It also said school officials should not issue a Form I-20, "Certificate of Eligibility for Non-immigrant Student Status," for a student in new or initial status who is outside of the United States and plans to take classes at an certified educational institution fully online.

The ICE said on Friday that the guidance applies to continuing F and M non-immigrant students who were in valid F-1 or M-1 non-immigrant status on March 9, 2020, including those previously enrolled in entirely online classes who are outside of the United States and seeking to re-enter the country this fall.
 
The announcement came less than two weeks after the ICE rescinded a new directive that could have denied international students their stay in the United States if they only attend online courses in this year's fall semester.


The government's new order bars thousands from getting employed or joining work-study programs in the US. It restricts American companies from hiring foreigners and blocks spouses of foreigners working in the US from entering the country. This move will also have serious consequences for Indian techies and the domestic IT industry.

The rule was criticized by states and academic establishments as a method to strain schools and universities to reopen their campuses with in-person courses throughout the pandemic. It comes as coronavirus circumstances are spiking in states throughout the nation. Seventeen states and the District of Columbia filed a lawsuit in opposition to the Trump administration`s worldwide pupil ban.

The lawsuit, filed within the U.S. District Court in Massachusetts, challenges the order and calls it “cruel, abrupt, and unlawful action to expel international students amidst the pandemic that has wrought death and disruption across the United States.”

This policy is the most sweeping ban on immigration in American history.
